1. Definitions

"Nymbus" refers to the company operating the services described herein, registered in Malaysia and located at Jalan SS2/24, 47300 Petaling Jaya, Selangor.

"Service" means any reference library, comparison toolkit, written report, or other resource made available by Nymbus under a current order or subscription arrangement.

"User" means any individual or organisation that has accepted these terms and holds an active order or subscription.

"Reference Materials" means charts, methodology documents, data summaries, comparison sheets, and written reports produced or maintained by Nymbus.

2. Scope of Service

Nymbus provides reference information and organisational tools to support internal planning discussions relating to AI compute workloads. The materials are prepared and presented as general information resources only. Nothing in any Nymbus output constitutes professional advice of any kind, including technical, financial, legal, or procurement advice.

The three current service categories are:

• Benchmark Reference Library — a single-seat reference subscription with quarterly updated materials.
• Comparison Toolkit — a team tool for up to ten users, including saved comparison sheets and export options.
• Custom Insight Report — a one-off written report delivered with a discovery call and a walkthrough session.

Service descriptions on the Nymbus website represent the general scope at the time of publication. Exact deliverables for bespoke engagements are confirmed in writing prior to commencement.

3. Access and Accounts

Access credentials, where issued, are for the named user or named team only. Credentials must not be shared with individuals outside the scope of the subscription. You are responsible for maintaining the confidentiality of your credentials and for any activity that occurs under them.

Nymbus reserves the right to suspend or terminate access where a material breach of these terms is identified, after providing written notice where practicable.

4. Permitted Use

Reference Materials accessed through a Nymbus service may be used for internal planning purposes within your organisation. You may produce internal summaries or presentations that draw on the materials, provided the source is acknowledged.

• You may not redistribute, resell, or sub-license the Reference Materials to third parties.
• You may not reproduce the materials in public-facing publications without prior written consent from Nymbus.
• Systematic extraction or bulk downloading of content beyond normal usage patterns is not permitted.
• The Reference Materials must not be presented as original work created by your organisation.

5. Intellectual Property

All Reference Materials, methodology documents, interface elements, and written content produced by Nymbus remain the intellectual property of Nymbus. Subscription access or payment for a service does not transfer ownership of any materials.

Feedback or suggestions submitted to Nymbus may be used to improve services without obligation to the submitter. Where a Custom Insight Report is prepared specifically for your organisation and you have paid in full, you receive a non-exclusive licence to use that report internally for an indefinite period.

6. Data and Privacy

Your personal data is handled in accordance with the Nymbus Privacy Policy and Malaysia's Personal Data Protection Act 2010. By using the service, you acknowledge that Nymbus may process contact and usage data as described in that policy.

For team subscriptions, your organisation's administrator is responsible for ensuring that any individual user data shared with Nymbus is handled in accordance with applicable data protection obligations within your organisation.

7. Payments and Subscriptions

Current pricing is displayed on the Nymbus website in Malaysian Ringgit (RM). All prices are subject to applicable taxes where required. Nymbus will confirm total payable amounts before any order is finalised.

• Benchmark Reference Library (RM 470): Billed at the start of each subscription period. Quarterly update cycles are counted from the subscription start date.
• Comparison Toolkit (RM 1,600): Billed at the start of each subscription period covering up to ten named users.
• Custom Insight Report (RM 4,700): A deposit may be required to commence a discovery call. The remaining balance is due on delivery of the written report.

Nymbus will issue payment instructions by email. Services are activated upon confirmation of cleared payment.

8. Cancellation and Refunds

For subscription services, you may request cancellation at any time. Cancellation takes effect at the end of the current billing period; access continues until that date. Fees paid for the current period are non-refundable unless a material service failure has occurred.

For Custom Insight Reports, cancellation prior to delivery of the final written report may result in a partial charge proportional to work completed. Nymbus will provide a written breakdown of work completed at the time of cancellation.

9. Disclaimers

Nymbus Reference Materials are provided for information and planning discussion purposes only. They do not constitute advice, recommendations, or endorsements of any hardware, software, or vendor.

Benchmark figures and reference data reflect information available at the time of compilation. Technology changes rapidly and figures should be treated as indicative rather than definitive. Users are responsible for independently verifying information before acting on it in any procurement or operational decision.

Nymbus does not warrant that the service will be uninterrupted or error-free at all times, though reasonable steps are taken to maintain availability during normal business hours.

10. Limitation of Liability

To the extent permitted by Malaysian law, Nymbus's total liability arising from or in connection with the service shall not exceed the fees paid by the user in the twelve months preceding the relevant claim.

Nymbus shall not be liable for indirect, consequential, or incidental losses arising from use of or reliance on the Reference Materials. This does not affect any rights you may have as a consumer under applicable Malaysian law.

11. Governing Law

These terms are governed by the laws of Malaysia. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Malaysia, unless an alternative resolution mechanism is agreed in writing by both parties.

12. Amendments

Nymbus may update these terms from time to time. Material changes will be communicated to active subscribers by email at least fourteen days before taking effect. Continued use of the service after the effective date of an update constitutes acceptance of the revised terms.
